BrightPeak Window Care LLC | EFFECTIVE: Aug 12, 2026
1. Safety & Right of Refusal
- Safety First: Safety is our highest priority. Due to the dangerous nature of exterior window cleaning and ladder work, we reserve the right to walk away from or refuse any job or specific window that presents an unreasonable safety or liability risk.
- Scope of Work: We reserve the right to refuse service if a project falls outside our technical scope of work or safety parameters.
1.2. Legalities
- Independent Contractor Status: BrightPeak Window Care is an independent contractor and not an employee of the client.
- Insurance Disclosure: BrightPeak Window Care carries general liability insurance. Proof of insurance is available upon request.
- Limitation of Liability: In no event shall BrightPeak Window Care's total liability for any claims, damages, or losses arising out of or related to our services exceed the total amount paid by the client for the specific service provided, except to the extent such claims, damages, or losses result from BrightPeak Window Care's gross negligence or intentional misconduct, in which case this limitation shall not apply.
- Dispute Resolution: In the event of a dispute arising from this agreement, both parties agree to attempt to resolve the issue in good faith through direct communication. If the issue remains unresolved, both parties agree to seek mediation before pursuing litigation.
1.3. Cancellations, Weather & Rescheduling
- Cancellation Notice: We require at least 48 hours' notice for any cancellations or schedule changes.
- Cancellations made with less than 48 hours' notice are subject to a 10% job charge.
- Same-day cancellations or lock-outs are subject to a 30% job charge.
- Policy fees may be waived for reasonable emergencies beyond the Client's control.
- Rain & Inclement Weather: Rain alone does not make windows dirty; rain activates existing dirt on glass. Clean glass stays clean in the rain.
- We reserve the right to reschedule services due to severe weather (high winds, lightning, freezing temperatures, or heavy downpours) for safety reasons.
- If light rain occurs, services will generally proceed as scheduled.
- Cancellation by BrightPeak Window Care: We make every effort to maintain our scheduled appointments. Should a modification or cancellation become necessary, we will also provide a minimum of 48 hours' notice. Any cancellations by our team within 48 hours of the scheduled job will occur only because of unforeseen emergencies beyond our control.
2. Minors & Property Access
- Minors Present: An adult (18 years or older) must be present at all times while work is being performed if a minor is on the premises. If our crew arrives and a minor is home alone, service will be canceled, and our same-day cancellation fee may apply. This applies to work being performed inside the home, but may not if work is strictly being performed on the exterior of the home.
- Vacant Properties: Services can be performed on vacant homes or unoccupied properties provided access instructions are given to us prior to our arrival.
- General Access: The Client must grant clear access to all areas requiring service, including unlocking gates, providing entry codes, and clearing obstructions. If access cannot be gained, rescheduling or waiting fees may apply.
- Utilities: The Client must provide clear access to an operational on-site exterior water supply and electrical outlets if needed.
3. Pets & Property Preparation
- Securing Pets: For the safety of your pets and our technicians, please secure all animals indoors or away from working areas. Pets can act unpredictably around equipment and strangers.
- Access Points: Our technicians frequently open doors, gates, and windows during service. We love animals and will do our best to keep your pets safe, but BrightPeak Window Care is not responsible for unsecured pets that escape during normal operations.
- Permission to Enter the Property: By hiring BrightPeak Window Care, you grant permission for us to access any parts of the property necessary to complete the services specified by the client in the booking process.
- Moving Valuables/Breakables: The Client is asked to move all fragile items, decorations, blinds/drapes, window sill clutter, and light furniture away from window work areas prior to our arrival.
- Trees, Bushes, and Landscaping: Many people have trees, bushes, or other plants planted in front of, underneath, or nearby their windows. In the event that the client requests that these windows be cleaned, we will do our very best to get quality results without harming any plants or shrubbery. However, we are not responsible for damage caused to any trees, bushes, flowers, or other vegetation during or after the cleaning process. This includes soap solution that may get on the grass. (When diluted to our standard application strength, soap solution will not harm lawn turf. Yet we are not responsible for dead spots in the lawn.) If the windows are inaccessible to clean without inevitably damaging plants/vegetation, we will skip those windows.
4. Estimates, Pricing & Price Adjustments
- Estimate Accuracy: Quotes are based on information provided by the Client. If window count, condition, or access details were answered incorrectly, we reserve the right to adjust the final price or cancel the agreement before starting work. Changes in pricing will be agreed upon and approved by the client prior to beginning the work.
- Validity: Written estimates are valid for 30 days from the date issued.
- Price Changes: Due to rising material, fuel, and inflation costs, BrightPeak Window Care reserves the right to adjust pricing for recurring or future services. Clients will always be notified of price changes prior to service commencement.
5. Payment Terms & Saved Cards
- Due Upon Receipt: All payments are due immediately upon service completion unless prior written payment arrangements have been established.
- Accepted Forms: We accept major Credit/Debit cards, Cash, Check, Venmo, Zelle, and ACH Bank Transfer. We use Square as our secure processor.
- Card on File: If you save a payment card on file through Square for deposit or recurring cleaning services, you authorize BrightPeak Window Care to charge the stored card for completed services or applicable cancellation fees. We cannot view card information - only the last 4 digits are visible to us in the event the client desires confirmation of which card was used.
- Recurring Charge Authorization: By checking the box during your booking process, you provide express and separate authorization for BrightPeak Window Care to charge your card on file for all recurring or subsequent services. This consent is distinct from any other agreement and confirms your authorization for ongoing automated charges associated with your service schedule.
6. Accidental Damage vs. Pre-Existing Conditions
We treat your property with the utmost care. In the event accidental damage occurs as a direct result of our negligence or improper tool use, BrightPeak Window Care will repair or replace the damaged item. However, if an item breaks under normal, intended operation due to pre-existing wear, age, or sun damage, the Client assumes full financial responsibility.
Specific Limitations & Waivers:
- Scratches & Tempered Glass: Glass naturally reveals existing scratches, fabrication debris, and manufacturing imperfections once dirt is removed. Tempered glass often contains microscopic fabricating debris that can dislodge during standard cleaning methods. BrightPeak Window Care uses industry-standard, safe glass cleaning practices and is not liable for pre-existing scratches or fabricating debris damage.
- Bent or Ripped Screens: Window screens naturally oxidize and deteriorate from sun exposure over time. We remove and reinstall screens carefully using proper techniques, but we are not liable for brittle frames, grip tabs, or mesh that bend, break or tear under standard removal force due to age. Old/weathered screens can be unintentionally damaged fairly easily.
- Broken / Failed Window Seals: A broken seal causes moisture, fog, or hazing inside double or triple-pane glass units. This is a structural failure of the window manufacturing/installation, not a result of surface cleaning. We are not liable for seal failures.
- Hard Water & Mineral Staining: Mineral deposits from sprinklers, rainwater runoff, or pressure washing chemically etch into the glass over time. Standard cleaning will not remove deep mineral etching. While specialized removal techniques can restore glass, BrightPeak Window Care is not liable for permanent, deep-set mineral staining.
7. Project Exclusions & Special Equipment
- Special Equipment: Projects requiring rented boom lifts, scaffolding, or specialized machinery will be billed at actual rental cost plus a 15% administrative fee. In the event that such equipment is necessary, we will not proceed until consent has been given by the client.
- Exclusions: Unless explicitly detailed in your written quote, our pricing excludes: traffic control, permitting, trash hauling, screen repair/drilling, standby time for other trades, nighttime work, or secondary water sourcing.
- Trash Can Cleaning: We are partnered with Trash Blasters Utah LLC to make booking both window cleaning services and trash can cleaning services seamless and simple. But we are two separate companies. Trash Blasters Utah is their own entity and as such, hold in effect their own set of terms and conditions for their specific scope of work. BrightPeak Window Care is not responsible for damage caused by Trash Blasters Utah. See their website for their own separate terms and conditions.
8. Satisfaction Guarantee
- Our Commitment: We want you to be completely satisfied with our work. If you notice a defect or quality issue with our cleaning, please contact us within 48 hours of service completion. We will gladly return to fix the issue at no additional cost or issue a reasonable refund/credit upon inspection.
9. Services
- What We Offer: We offer Interior and Exterior Window Cleaning, Window Screen cleaning, Frame, Sill, and Track detailing, and Hard water removal. The particular scope of work for a specific job will be selected and outlined by the client during the booking process.
10. Adjustments to Terms of Service and Governing Laws
- Modifications to Terms: We reserve the right to amend these Terms and Conditions periodically. The version of these terms in effect at the time of your booking will govern that specific job. For recurring service agreements, your continued use of our services after any changes have been posted to our website constitutes your binding acceptance of the updated Terms and Conditions.
- Governing Law & Venue: This agreement shall be governed by and construed in accordance with the laws of the State of Utah. Any disputes arising from or relating to this agreement shall be exclusively resolved in the courts located in Salt Lake County, Utah, following the mediation process outlined in Section 1.2.
